This section is intended to explain how Whitewater Freight may assist with a claim and what the claimant acknowledges when submitting claim information.
Claimant acknowledgment
By submitting this claim information, the claimant represents that the information provided is true and accurate to the best of the claimant’s knowledge, and that the claimant is authorized to present the claim for the shipment, goods, loss, damage, shortage, or expense described.
The claimant acknowledges that claim documentation may be required to support the amount claimed, including but not limited to the bill of lading, proof of delivery, delivery receipt, commercial invoice, packing slips, repair invoices, photos, inspection records, replacement invoices, salvage information, and a detailed statement showing how the claimed amount was calculated.
The claimant agrees to preserve the damaged goods, packaging, and related materials when reasonably possible, and understands that such goods may need to be made available for inspection or salvage review.
Authorization to assist with claim presentation
By submitting this form, the claimant authorizes Whitewater Freight Inc. to assist with the preparation, communication, presentation, administration, and follow-up of the claim on the claimant’s behalf. This may include sharing claim information and supporting documents with the applicable motor carrier, insurer, claims administrator, adjuster, shipper, consignee, or other party reasonably involved in the claim review process.
The claimant understands that Whitewater Freight’s assistance with claim presentation is an administrative and customer support service and does not make Whitewater Freight the insurer of the goods or guarantee that the claim will be approved, paid, or resolved for the amount requested.
Limitations and responsibility
Any claim recovery may be subject to the applicable bill of lading, carrier tariff, carrier rules, contract terms, declared value, released value, insurance coverage, exclusions, limitations of liability, applicable law, and the availability and sufficiency of supporting documentation.
Unless otherwise agreed in writing by an authorized representative of Whitewater Freight, Whitewater Freight does not assume liability beyond its role as a freight broker or logistics service provider and does not waive any defenses, limitations, exclusions, or rights available under applicable contracts, tariffs, law, or governing terms.
The claimant remains responsible for providing complete and accurate documentation, cooperating with claim investigation, preserving evidence, mitigating further loss when reasonable, and complying with any applicable claim filing deadlines or procedures.
Payment direction
Any monies determined to be due on an approved claim will be payable to the claimant or other legally authorized payee, unless otherwise required by written agreement, assignment, insurer direction, or applicable law.
